1. GENERAL TERMS & CONDITIONS

This document establishes the General Conditions of Use and the General Conditions of Online Sale of the Luzia Lisbon website. Browsing the website and/or purchasing any product through it implies acceptance of these General Conditions.

1.1 Ownership of the Online Shop

The domain and online store are available at www.luzialisbon.com (hereinafter referred to as the “online store” or “website”) is the property of Nuvem Malabarista, Lda, with registered office at Rua José Maria Nicolau 6, 2D 1500-662 Lisboa - Portugal, with VAT number 517429640 and owner of the Luzia brand.

1.2 Scope of application

These General Conditions regulate the visit/browsing and the purchase and sale operations carried out in the online store, between any natural person who uses it for a purely personal purpose, as a final consumer, with no intention of reselling the items they purchase there, and Luzia Lisbon as the party responsible for marketing its products through this online store.

The User undertakes to use this website in compliance with the provisions of the applicable legislation, refraining from using the page for activities contrary to the law, morality and good customs, or the rights and interests of third parties.

All brands, distinctive signs, images, texts, photographs and any other work reproduced or represented in the online store are considered intellectual property of Luzia Lisbon and, as such, are protected by the rules of Industrial Property Law. Any total or partial reproduction or representation of the website or any elements on it is therefore prohibited.

1.3 Amendments to these Conditions

Luzia Lisbon reserves the right to freely modify the General Conditions at any time in order to adapt them to the applicable legislation, without the need for any prior notice.

It also reserves the right to unilaterally modify, at any time and without prior notice, the presentation and content of the website regarding products, prices, promotions, commercial conditions and services. These modifications will serve to improve the website, while at the same time improving the services offered to the User.

Despite all the care taken in preparing the contents of the website, the information, texts, graphic documents and/or other services may contain errors or be incomplete. In these situations, Luzia Lisbon cannot be held responsible for any damage resulting from the use (or inability to use) the website, including damage caused by viruses or any inaccuracy or imperfection of the information.

1.4 Commercial policy

The sale underlying each order placed by the Customer is made under reservation of title, whereby the products remain the property of Luzia Lisbon until full and effective payment of the amount due.

1.5 Product information

Luzia Lisbon takes into account information on the essential characteristics of the products through technical descriptions shared by its suppliers, and photographs illustrating the products sold.

The images and photographs of the products, although trying to be as accurate as possible, are merely illustrative, so the Customer should consider the possibility of differences in color, appearance of shape/form, which may also be due to the monitor and web browser used by the Customer. 

1.6 Price information

The retail prices indicated in the online store are shown in euros (€) and are subject to Value Added Tax (VAT) at the legal rate in force. Unless otherwise stated, the advertised prices include VAT.

Shipping costs are borne by Luzia Lisbon for purchases of €200 or more and delivery to mainland Portugal and the islands. For purchases of less than this amount or for deliveries to any other territory, the shipping costs are as indicated below.

For any purchase of less than €200 or with delivery to other territories, the shipping service costs are borne by the User/Buyer and are added to the total value of the products selected. The User will be informed of these charges before confirming their order and completing the purchase process.

Luzia Lisbon reserves the right to change prices at any time. However, it undertakes to apply the rates and prices indicated when the purchase order was placed.

In the event of a computer, manual, technical or other error causing a substantial change not foreseen by Luzia Lisbon in the retail price, the purchase order will be considered invalid and cancelled.

The price of the products is that stipulated on the Luzia Lisbon website. Although every effort is made to ensure that the prices published on the website are correct, errors may occur. If Luzia Lisbon detects an error in a price, the Customer will be informed and given the option of confirming their order with the correct price or canceling it. If it is not possible to contact the Customer, Luzia Lisbon will consider the order canceled and all amounts paid will be refunded in full.

Shipping fees are calculated per order, and the exact price of the shipping fee will depend on the country where your order will be delivered.

1.7 Buying process

To place a purchase order, go to www.luzialisbon.com and follow the steps below.

1.8 Register

As an initial step, the User/Buyer must register as a Customer on the website www.luzialisbon.com by filling in the electronic form following the instructions for each step. Once registered, the User can proceed to purchase their product(s).

It is the Customer's responsibility to ensure that all the necessary data is provided correctly and completely, as only in this way can Luzia Lisbon guarantee acceptance of the order and subsequent delivery.

1.9 Ordering

While browsing the online store, the Customer will be able to see all the available items and variants, and can select those that best suit their purchasing needs. They must insert the items they wish to purchase into the virtual shopping basket and can, whenever they wish, delete any of the items previously inserted there, without prejudice to ordering other products. Once you have finished choosing, you should review your order and check that it is in order and finalize the process. You should then proceed with payment, thus confirming your order.

The fulfillment of all orders placed on the site is subject to product availability. Luzia Lisbon tries to ensure that all items offered for sale on the site are in stock. However, Luzia Lisbon reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In the event of product unavailability and/or out of stock, Luzia Lisbon will immediately inform the Customer of the partial or total cancellation of their order, and the Customer is entitled, if applicable, to a refund of the respective amount paid.
